What Texas HB 2024 Means for Hemp Customers in 2025

A new piece of legislation, Texas House Bill 2024 (HB 2024), is set to take effect on September 1, 2025, and it will bring significant changes to the products we’re able to offer. This blog breaks down what the bill means, why it was passed, how Elevated Hemp Co. is responding, and what you can expect moving forward.
The Basics of HB 2024
HB 2024 was introduced as part of Texas’ ongoing regulation of vaping and disposable devices. On the surface, the bill was primarily designed to crack down on nicotine disposables being imported from overseas, especially from China. These devices, according to state lawmakers, raised concerns about safety, youth access, and unregulated products making their way into the hands of Texans.
However, the final language of the bill went much further than addressing nicotine. Lawmakers included additional text that bans all cartridges, disposables, and pod systems containing any type of cannabinoid, regardless of whether the device was made in the United States or abroad.
This means that any hemp-derived cart, pod system, or disposable vape containing cannabinoids such as CBD, CBG, Delta-8, Delta-9, or THCA will be prohibited for sale in Texas starting September 1, 2025.
What This Law Does Not Ban
It’s important to note that HB 2024 does not ban hemp entirely. In fact, the law specifically targets only carts, disposables, and pod systems.
Other hemp products remain completely legal in Texas, including:

THCA and CBD hemp-derived flower

Hemp-Derived Edibles such as gummies, chocolates, and beverages

Hemp-Derived Concentrates like hash, rosin, and wax
These categories continue to be available both online and in-store through Elevated Hemp Co. The hemp plant itself and the many ways it can be consumed legally are still protected under the 2018 Farm Bill and Texas state law, at least for now.
Why This Ban Happened
The frustrating truth is that HB 2024 wasn’t really about hemp to begin with. The original push was to reduce the influx of nicotine vapes being imported from China and sold in convenience stores, gas stations, and smoke shops across the country.
But in the process, lawmakers used the opportunity to sneak in language that directly impacts hemp products. By including cannabinoids in the bill, they extended the ban to cover hemp-based disposables, cartridges, and pods, products that many of our customers prefer for their convenience and portability.
In short, while the stated target was nicotine vapes, hemp was caught in the crossfire.
Our Response
At Elevated Hemp Co., we take pride in being fully compliant with state and federal laws. Even when those laws don’t make sense, we believe our customers deserve a business that operates with integrity and transparency.
That means that starting on August 31, 2025, we will be removing all hemp-based carts, disposables, and pod systems from our website and shelves to comply with HB 2024.
We know this is disappointing news. Many of you rely on carts and disposables for their convenience, and they’ve been among our most popular products. But we will never risk our customers’ trust or our company’s standing by cutting corners or ignoring the rules.
You may notice other shops or gas stations continue to sell carts and disposables after the ban takes effect. While that may happen, it is not the path we’re taking. Compliance comes first, always.
The Fight Isn’t Over
While HB 2024 is set to become law on September 1st, 2025, there is still hope. Several hemp companies and advocacy groups are preparing to challenge the bill in court. If an injunction is granted, the ban on hemp-based carts and disposables could be temporarily lifted while the case plays out.
If that happens, Elevated Hemp Co. will be ready to bring carts and disposables back to our shelves quickly, and in full compliance with the law.
We remain hopeful that common sense will prevail and that hemp will not continue to be unfairly targeted. In the meantime, we will continue to advocate for fair hemp regulations and keep our community updated every step of the way.
The Bigger Picture: Texas and Hemp
It’s worth mentioning the broader context here. Earlier this year, Texas lawmakers attempted to pass an outright hemp ban. If passed, that bill would have effectively eliminated the hemp industry in the state altogether.
Thankfully, Governor Greg Abbott vetoed the outright ban, stopping it from becoming law. That veto was a major victory for hemp businesses and consumers alike.
However, the fight is far from over. Texas is currently in Special Session #2, and hemp advocates are keeping a close eye on new developments. Our hope is that lawmakers will come to their senses and work toward reasonable, common-sense hemp regulations instead of blanket bans that harm small businesses and consumers.
What This Means for You as a Customer
Here’s what you need to know as an Elevated Hemp Co. customer:
